Having considered the papers, including all supplemental papers, filed in connection with the Motion for Final Approval of $140,000 Class Action Settlement, the Court continues to have the following concern:

Nothing was attached to the Objection Forms submitted by Juan Padilla and Thomasine Holt, and the grounds for the objections were not included in the Objection Forms. Did the Settlement Administrator discuss the objections with the objecting Class Members to find out what the bases for the objections were and/or if they did actually intend to object?

If this issue is resolved to the satisfaction of the Court at the hearing, the Court is inclined to GRANT the Motion subject to the following:

$ 5,000.00 for Plaintiff’s Enhancement;

$ 46,666.66 for Attorney’s Fees; 

$ 8,610.17 for Litigation costs; and 

$ 14,900.00 for Settlement Administrator’s Fees and Costs. 

Plaintiff is ordered to submit a revised proposed Order within 5 court days that includes a reference, including the ROA #, to the Second Amendment, and provides that the Judgment is to be posted on the Settlement Administrator’s website for 180 days.

Plaintiff is ordered to give notice and file a proof of service at least 5 court days before the continued hearing.
