Plaintiffs’ motion to strike and/or tax defendant’s costs and expenses (filed 7/21/22)

Tentative ruling:  GRANT.  Defendant’s costs are taxed by striking and disallowing the expert witness fees itemized in the Memorandum of Costs (Summary) filed on 7/7/22 in the amount of $6,117.00.   In its Memorandum of Costs, Defendant does not support its request for expert witness fees/costs and the court is unable to determine whether and to what extent CCP §998 applies.  The court does not consider Defendant’s egregiously untimely opposition, filed and served on 9/14/22, two days before the hearing.  The judgment will be amended to interlineate the costs which the court allows Defendant, i.e., $1,490.00.
