Judge: Randall J. Sherman, Case: 2014-00738848, Date: 2022-09-02 Tentative Ruling

The tentative ruling is to continue the Final Report Hearing to July 14, 2023 at 10:00 a.m., for confirmation that the amount of the uncashed checks has been delivered to the State Controller’s Office Unclaimed Property Fund in the names of the applicable payees.  A declaration from the Administrator must be filed at least 16 days before the new hearing date.

In addition, within 14 days, plaintiffs’ counsel must file a declaration explaining why, according to the Declaration of Elizabeth Kruckenberg on Behalf of Settlement Administrator filed on 8/3/21 (ROA 994) there were 116 notice packets mailed on 3/19/21, none of which were returned as undeliverable, yet according to the Declaration of Jarrod Salinas Regarding Disbursement filed on 8/10/22 (ROA 1030), only 84 class member checks were mailed.

Plaintiffs are ordered to give notice to defense counsel unless notice is waived.
