Judge: Randall J. Sherman, Case: 2019-01077086, Date: 2022-12-16 Tentative Ruling

Based on the administrator’s declaration, the tentative ruling is to set the Final Report Hearing for Thursday, September 28, 2023 at 10:00 a.m., for confirmation that the last of defendants’ installment payments has been received, that the second set of distributions that are scheduled to be made on or about January 27, 2023 have been made, and that the amount of the uncashed checks has been delivered to Public Law Center.  A declaration from the Administrator must be filed at least 16 days before the new hearing date.  Plaintiff also must submit at least 16 days before the new hearing date an Amended Judgment that complies with CCP §§384(b) and 384.5, and Gov. Code §68520, because a portion of the Judgment is being paid to a nonparty, Public Law Center.  Specifically, the Amended Judgment must state how much money is being paid to the nonparty, including any interest that accrued on the funds, and, if known, the purpose of the distribution to the nonparty and how it plans to expend the funds.  In addition, the parties must report to the court the total amount that was actually paid to the class members.

 

Plaintiff is ordered to give notice to defense counsel unless notice is waived.
