Judge: Randall J. Sherman, Case: 2019-01083428, Date: 2022-10-07 Tentative Ruling

The tentative ruling is to continue the Final Report Hearing to September 29, 2023 at 10:00 a.m., for confirmation that the amount of the uncashed checks has been delivered to the State Controller’s Office Unclaimed Property Fund in the names of the applicable payees, or if the funds have not yet been delivered, an estimate of when that is expected to occur.  A declaration from the Administrator must be filed at least 16 days before the new hearing date.

The court will not be signing the Second Amended [Proposed] Order submitted by plaintiff on September 19, 2022.  Because the funds from the uncashed checks are not being paid to a cy pres nonprofit organization, the requirement in CCP §384(b) for an amended judgment is not applicable.

Plaintiff is ordered to give notice of the ruling to defense counsel unless notice is waived.
