Defendants’ Motion for Order to File Under Seal Portions of Individual Settlement Agreement in Connection With Plaintiff Christopher Zaldana's Motion for Approval of PAGA Settlement is granted. Defendants have established the criteria set forth in CRC Rule 2.550(d). The court expressly finds that the facts establish: (1) There exists an overriding interest that overcomes the right of public access to the record; (2) The overriding interest supports sealing the record; (3) A substantial probability exists that the overriding interest will be prejudiced if the record is not sealed; (4) The proposed sealing is narrowly tailored; and (5) No less restrictive means exist to achieve the overriding interest. The fact that this is a PAGA action rather than a class action means that the provisions of CRC Rules 3.769 and 3.770 do not apply.
Defendants must submit a new proposed Order that includes the findings required by CRC Rule 2.550(d) and (e). In addition, defendants must submit a new Notice of Lodging (ROA #111) for public filing that includes all of Exhibit 1, except that in place of page 2 should be a page indicating that page 2 is redacted. Paragraphs 1 and 2 of the proposed Order should be modified accordingly.
Defendants are ordered to give notice of the ruling unless notice is waived.
