The tentative ruling is to continue the hearing on plaintiff’s Motion for Order Granting Preliminary Approval of Class Action Settlement to September 30, 2022 at 10:00 a.m.  Plaintiff may not file her First Amended Complaint until after 65 days elapse following the date plaintiff sent her third amended PAGA Notice to the LWDA on July 18, 2022, which time runs on September 21, 2022.  After that date, plaintiff may file her First Amended Complaint as a matter of right pursuant to Labor Code §2699.3(a)(2)(C).  Plaintiff should file her First Amended Complaint by September 23, 2022 to avoid another continuance.

Plaintiff is ordered to give notice of the ruling to the LWDA and to defendant.
