The tentative ruling is to continue the hearing on plaintiff’s Motion for Final Approval of Class Action and PAGA Settlement and Motion for Attorneys’ Fees, Costs, and Service Awards to December 16, 2022 at 10:00 a.m.  Counsel must file supplemental papers addressing the court’s concerns (not fully revised papers that would have to be reread) no later than 16 days before the next hearing date.

Plaintiff did not provide the court with the amount of the low individual payment to a class member, a requirement noted during the preliminary approval process.

An invoice from the Administrator is required to support its fee request, especially because ¶15 of the Declaration of Karen Hernandez says that the fee request is $9,700, while the proposed fee award set forth in ¶17 of the Proposed Order is $9,500.

The proposed Final Approval Order and Judgment must be amended to identify the two putative class members who opted out of the settlement.

Plaintiff is ordered to give notice of the ruling to defense counsel unless notice is waived.
