The tentative ruling is to continue the hearing on plaintiffs’ motion to have attorney Martin A. Little admitted pro hac vice to represent them in this action to November 17, 2023 at 10:00 a.m.
Plaintiffs have not complied with CRC Rule 9.40(c)(1) since they have not filed with the court a proof of service by mail of copies of the application and the notice of hearing of the application on the State Bar of California at its San Francisco office. A declaration asserting compliance is insufficient. The application also fails to comply with CRC Rule 9.40(d)(1) since it does not provide the applicant’s residence address. Finally, the applicant should specifically state, consistent with CRC Rule 9.40(a)(1), that he is not a resident of the State of California (if that is the case).
Supplemental documentation addressing these issues must be filed no later than two weeks before the new hearing date.
Plaintiffs are ordered to give notice of the ruling unless notice is waived.
