STATEMENT OF MATERIAL FACTS AND/OR PROCEEDINGS:
Plaintiff Tiffaney Luckett brings this action against her employer, Defendant Windsor Twin Palms Healthcare Center, where she worked as the Director of Staff Development. Plaintiff alleges Defendant(s) terminated her employment after contracting Covid-19.
Defendant Windsor Twin Palms (ABC), LLC, now demurrers to the Second Amended Complaint. Plaintiff filed a notice of non-opposition.
TENTATIVE RULING:
Defendant’s Demurrer to the Second Amended Complaint is MOOT.
Defendant is ordered to give notice, unless waived.
DISCUSSION:
Demurrer
On September 30, 2024, Defendant Windsor Twin Palms (ABC), LLC filed a demurrer to the Second Amended Complaint. On October 18, 2024, Plaintiff dismissed all causes of action against the moving Defendant without prejudice. (See 10-18-2024 Request for Dismissal.) On October 30, 2024, Plaintiff filed a non-opposition to the demurrer based on the dismissal.
Accordingly, Defendant’s Demurrer to the SAC is MOOT.
Defendant is ordered to give notice, unless waived.
