Matter on calendar for Tuesday, June 20, 2023, Line 7, PLAINTIFF BODERO & ASSOCIATES, INC.'S Motion To Enforce Settlement Agreement Plaintiff's motion to enforce settlement agreement is granted. Plaintiff demonstrates that defendant defaulted on the parties' settlement agreement. (Miyake Decl., pars. 10-11.) Defendant contends that plaintiff too defaulted because it failed to provide all of the documents required by section 2.1 of the parties' settlement agreement. (Bodero Decl., Ex. A; Vermili Decl., pars. 1-2.) Plaintiff rebuts this contention and shows that it performed the parties' agreement and/or excuse. (Miyake Decl., par. 14, Ex. E.) The motion is therefore granted.
