Matter on calendar for Friday, April 28, 2023, Line 7, PLAINTIFF MARVIN GEOVANY FLORES NAVARRO'S Motion For Approval Of Private Attorneys General Act Representative Action Settlement The settlement is approved except for the sum proposed for the named plaintiff. The sums for attorney's fees sought are less than the lodestar, whether one accepts the hourly rate proposed or a still reasonable lesser one. But with 253 aggrieved employees and a total of about $14,000 to be distributed to them, i.e. on average $55 per employee, it is unjust to award $5000 to the named plaintiff, even assuming these sorts of incentive awards are proper in a PAGA action. The sum is reduced to $1000 and the balance is to be redistributed as between the LWDA and the employees as provided by statute.
