CASE TITLE: CASE TYPE:

Civil - Unlimited  PI/PD/WD - Other Discovery Hearing 37-2021-00007831-CU-PO-CTL GARABEDIAN VS LIBERTY CHARTER HIGH SCHOOL [IMAGED] CAUSAL DOCUMENT/DATE FILED:

TENTATIVE RULING: PLANTIFF'S UNOPPOSED MOTION TO COMPEL DISCOVERY RESPONSES AND FOR SANCTIONS is GRANTED.

Failure to file an opposition to the motion indicates Defendants Georginne and Brian Parisi's ('Defendants') acquiescence that the motion is meritorious. (L.R. 2.1.19(B) ['The court may deem a lack of opposition to be a concession that a motion is meritorious']; See California Rules of Court, Rule 8.54(c).) The discovery was served on February 20, 2024. Defendants never responded, even after Plaintiff Andrew Garabedian by and through his Guardian Ad Litem Nabila Garabedian ('Plaintiff') attempted to meet and confer and offered an extension. Therefore, Defendants waived the right to object. (Code Civ. Proc., §§ 2030.290, 2031.300, and 2033.280.) The motion is granted. Defendants are ordered to provide responses to interrogatories and requests for production, without objections, within twenty (20) calendar days. Plaintiff's Request for Admissions, Set One, are hereby deemed admitted.

Plaintiff is awarded $2,000 in sanctions against Defendants and Defendants' counsel, jointly.
