Gary L. Chambers, Esq. of Chambers & Noronha moves for an order relieving them as counsel of record for Plaintiff Andrea Greenway (“Plaintiff”).
Counsel Chambers states in his declaration that Plaintiff has engaged in conduct such that it is unreasonably difficult for his office to effectively represent her interests; that as a result of Plaintiff’s conduct, there has been a breakdown of the attorney-client relationship; and a conflict has arisen between Plaintiff and the entire Law Offices of Chambers & Noronha. (Chambers Decl., ¶¶ 2-3.) Counsel Chambers also states the he feels that irreconcilable differences have arisen between the two which render it impracticable to continue in the attorney-client relationship. (Chambers Decl., ¶ 4.) Counsel Chambers additionally states that the motion was served to plaintiff’s last known address. (Chambers Decl., ¶ 5.) Here, Counsel Chambers has filed two proofs of service indicating service of the moving papers by mail and electronic transmission on Marc S. Lafer, Esq., counsel for Defendants, Loan Nguyen Vyas and Bhaskar Vyas, Cheyenne McKloski and Andrea Greenway (ROA 150), as well as personal service of the moving papers on Plaintiff (ROA 152).
All the requirements of California Rules of Court, Rule 3.1362 have been met, and Counsel Chambers presents sufficient grounds for being relieved as counsel of record for Plaintiff, Andrea Greenway.
Thus, the Motion to be Relieved as Counsel filed by Gary L. Chambers, Esq. of Chambers & Noronha as counsel of record for Plaintiff, Andrea Greenway is GRANTED.
However, the Court notes that the Order Granting Attorney’s Motion to be Relieved as Counsel on Judicial Council Form, MC-053 does not reflect the currently scheduled hearing and trial dates. (ROA 146.) Counsel Chambers to prepare and submit an updated Proposed Order at the hearing on the motion.
Said Order is effective upon Counsel Chambers filing a proof of service of a copy of the signed order, and this Minute Order, on the client and on all parties that have appeared in the case. (California Rules of Court, Rule 3.1362(e).)
