Plaintiff Dien Tran (“Plaintiff”) filed the following three motions: (1) Motion to Compel Further Responses to Interrogatories from Defendant Dedicated Transportation Services, Inc., see ROA # 198, 199, 200, and 201; (2) Motion to Compel Further Responses to Requests for Admission from Defendant Dedicated Transportation Services, Inc., see ROA # 205, 206, 207, and 208; and (3) Motion for Sanctions against Defendant Dedicated Transportation Services, Inc. and its Attorney McMillian, see ROA # 192, 193, and 194.
Plaintiff failed to file a proof of service for the documents filed in support of each motion. (Code Civ. Proc., §§ 1011, 1013, 1013a and 1013b; Cal. Rules of Court, rules 1.21 and 2.251.)
As such, the motions are DENIED with leave to refile and serve the moving papers within 14 days of this order.
If the moving papers are refiled and served after the 14-day leave period has elapsed, any days after the leave period will count in computing the timeliness of the motions under the applicable statutes.
