Plaintiff Employers Preferred Insurance Company (“Plaintiff”) filed its Notice of Motion and Motion for Order Applying Proceeds from Sale of Liquor License in Satisfaction of Judgment and Injunctive Relief in Aid of Receiver on May 26, 2022. (ROA 27.)
On August 25, 2022, Plaintiff filed a “Notice of Taking Motion for Order Applying Proceeds from Sale of Liquor License in Satisfaction of Judgment Off Calendar,” indicating that it was taking the instant motion, then set for September 1, 2022, off-calendar. (See ROA 31.)
On August 30, 2022, the Court issued a minute order stating, “Pursuant to the Notice of Taking Motion for Order Applying Proceeds from Sale of Liquor License in Satisfaction of Judgment Off Calendar, the Motion for Order Applying Proceeds from Sale set for 09/01/2022 at 1:30 PM in Department W15 is taken off calendar.” (ROA 34.) The court ordered Clerk to give notice. (Ibid.)
The Clerk gave notice by electronic service on Plaintiff’s counsel on August 30, 2022. (ROA 35.)
Thereafter, on September 1, 2022, the Court issued a minute order requiring Plaintiff to give notice of the hearing date of September 1, 2022, and continuing the matter to December 15, 2022. (ROA 38.) Plaintiff was ordered to give notice of the hearing date “to file proof of same with the Court at least 9-Court days prior to the new hearing date.” (Ibid.) The Clerk was to give notice to Plaintiff and Plaintiff was to give notice to all other parties. (Ibid.)
It appearing to the Court that through error or inadvertence, the Minute Order of this Court dated September 1, 2022, does not properly reflect the order of the Court and was issued in error, the court makes the following order nunc pro tunc.
Plaintiff’s Motion for Order Applying Proceeds from Sale of Liquor License in Satisfaction of Judgment and Injunctive Relief in Aid of Receiver is taken off-calendar pursuant to the Notice of Taking Motion for Order Applying Proceeds from Sale of Liquor License in Satisfaction of Judgment Off Calendar.
Clerk to give notice to Plaintiff and Plaintiff to give notice to all other parties.
