Defendant AB Capital, LLC (“Defendant”) moves to compel Plaintiff FCI Lender Services, Inc. (“Plaintiff”) to submit this matter to judicial reference pursuant to the parties’ Master Loan Servicing Agreement (the “Agreement”).   

As indicated in the Court’s September 1, 2022 order, the Court will grant Defendant’s Motion after addressing the appointment of a referee.  The Court continued this matter to September 29 and ordered the parties to either stipulate to the appointment of a referee or, if the parties could not agree, file and serve a statement identifying up to three nominees for appointment as referee. 

On September 14, 2022, the parties filed a joint stipulation agreeing to the appointment of Hon. James Gray (Ret.) through ADR Services, Inc.

In light of the foregoing, the Court GRANTS the Motion and, pursuant to Code of Civil Procedure section 640, appoints Hon. James Gray (Ret.) as referee.
