Ara Joe Keropian of AJK Law Firm moves for an order reliving him as Counsel of Record for Defendant, 90265 Films, LLC.

The instant motion was initially set for February 1, 2023, but was advanced to August 17, 2023, per the Court’s July 31, 2023 Minute Order (ROA 150.) Moving Counsel was ordered to give notice of the advanced motion, and was directed to submit a new proposed order for the Motion to be Relieved as Counsel of Record with the motion and trial dates. (Ibid.)          

Based on the proof of service attached to the “Notice of Ruling; Notice of New Hearing Date on Motion to be Relieved; Notice of New Trial Date,” Moving Counsel served himself by email on August 2, 2023, as “Attorneys for Defendant 90265 Films, LLC” and served Defendant, Christian Ashton, who is in pro per, by mail and email, on that same date. Said notice was also filed on that same date. (See ROA 143.)

The Court notes that there is a proof of personal service that was filed on August 2, 2023 (ROA 145), which indicates that a document entitled, “Notice of Hearing” was personally delivered to “90265 Films, LLC, Christian Ashton,” but the description of the document that was served is insufficient to determine that the document that was served was the Notice of Ruling filed on August 2, 2023.

Based on the foregoing, it is not clear that Moving Counsel properly served the client, Defendant, 90265 Films, LLC, with notice of the advanced hearing date of the instant Motion to be Relieved. To the extent that Christian Ashton might be the proper individual to be served on behalf of 90265 Films, LLC, Moving Counsel submits insufficient evidence showing this is the case.

Moreover, a new proposed order for the instant Motion to be Relieved as Counsel of Record with the motion and trial dates has not been submitted to the Court.

For the reasons above, the Court CONTINUES the instant motion for Moving Counsel to August 9, 2023 at 9 a.m. to rectify the deficiencies above. Moving Counsel to cure deficiencies before the continued hearing date.

Moving Counsel to give notice of the continued hearing date on the Motion to be Relieved as Counsel of Record on the client and on all other parties in the case.
