Petition to Approve Compromise of Pending Action on Behalf of Minor Claimant

The court considered the moving papers filed in connection with the petition.  No opposition papers were filed.  

DISCUSSION

Petitioner Karine Aladzhanzian filed the pending Petition for Approval of Compromise of Claim or Action on February 9, 2023. 

The court notes various defects with the petition.

First, the petition does not state the minor claimant’s name (1) in section 2, which requires identification of the claimant by name, or (2) in any of the other sections on judicial council form MC-350.  Although the court notes that it appears that the attachments to the petition indicate that the claimant may be Vahe Aladzhanzian, the claimant’s name must be stated on the petition itself.  The petition is therefore incomplete.

Second, petitioner Karine Aladzhanzian has not filed a proposed order on the petition, (Judicial Council form MC-351).

The court therefore exercises its discretion to continue the hearing on the petition for approval of compromise of claim or action to give petitioner Karine Aladzhanzian the opportunity to file a complete petition and proposed order on the petition.

The court orders that the hearing on the petition to approve the compromise as to the settlement between the subject minor claimant and defendants Par Engineering, Inc., and Navistar, Inc. is continued to March 30, 2023, at 10:00 a.m., in Department 53.

The court orders petitioner Karine Aladzhanzian to file with the court (1) a new, complete Petition for Approval of Compromise of Claim or Action or Disposition of Proceeds of Judgment for Minor or Person with a Disability (on form MC-350), and (2) a proposed Order Approving Compromise of Claim or Action or Disposition of Proceeds of Judgment for Minor or Person with a Disability (on form MC-351), no later than March 24, 2023.

The court orders petitioner Karine Aladzhanzian to give notice of this ruling.
