Motion to Compel Further Responses to Requests for Production of Documents

The court considered the moving and opposition papers filed in connection with this motion.  The court exercised its discretion to consider the untimely reply papers filed on September 29, 2023.

DISCUSSION

Defendant Grigor Demirchyan (“Defendant”) moves the court for an order (1) compelling plaintiff David Gasparyan (“Plaintiff”) to provide further responses to Defendant’s Requests for Production of Documents, numbers 2-9, and (2) awarding sanctions in favor of Defendant and against Plaintiff in the amount of $6,061.65.

The court grants Defendant’s motion to compel Plaintiff’s further responses to Requests for Production of Documents, numbers 2-9 because the objections to those requests are without merit.  (Code Civ. Proc., § 2031.310, subd. (a)(3).)  The court finds that each of those document requests is essentially a request that Plaintiff produce all documents which support an allegation in Plaintiff’s operative complaint.

The court denies Defendant’s request for monetary sanctions against Plaintiff because the court finds that the circumstances presented would make the imposition of sanctions unjust.  (Code Civ. Proc., § 2031.310, subd. (h).)

ORDER

The court grants defendant Grigor Demirchyan’s motion to compel further responses to requests for production as follows.

Pursuant to Code of Civil Procedure section 2031.310, the court orders plaintiff Davit Gasparyan (1) to serve on defendant Grigor Demirchyan further written responses to Requests for Production of Documents, numbers 2-9, and (2) to produce to defendant Grigor Demirchyan all documents and things in plaintiff Davit Gasparyan’s possession, custody, or control, which are responsive to those requests, within 20 days of the date of this order.

The court denies defendant Grigor Demirchyan’s request for monetary sanctions.

The court orders defendant Grigor Demirchyan to give notice of this ruling.
