Motion to Compel Responses to Requests for
Production of Documents, Set Two
The court considered the moving papers filed in connection with this
motion. No opposition was filed.
DISCUSSION
Defendant Canon Business Properties, Inc. (“Canon”) served its Requests
for Production of Documents, Set Two, on defendant Karlen Galstyan dba KG Road
Service (“Galstyan”) on November 18, 2021.
(Jones Decl., ¶ 5, Ex. A.) Canon
granted Galstyan an extension, making responses due on January 10, 2022. (Jones Decl., ¶ 7.) Galstyan has not provided responses. (Jones Decl., ¶ 9.)
Canon moves for an order (1) compelling Galstyan to provide responses
to Canon’s Requests for Production of Documents, Set Two, and (2) awarding
sanctions in favor of Canon and against Galstyan in the sum of $960.
Galstyan has not filed an opposition to Canon’s motion to compel, or
presented evidence establishing that he has served responses. The court therefore grants Canon’s motion to
compel Galstyan’s responses to its Requests for Production of Documents, Set
Two, served on Galstyan on November 18, 2021.
(Code Civ. Proc., § 2031.300, subd. (b).)
The court grants Canon’s request for monetary sanctions against
Galstyan. (Code Civ. Proc.,
§ 2031.300, subd. (c); Cal. Rules of Ct., rule 3.1348, subd. (a).) The court finds that $660 (3 hours x $200
hourly rate = $600 in attorney’s fees + $60 filing fee) is a reasonable amount
of monetary sanctions to impose against Galstyan on this motion. (Jones Decl., ¶ 10.)
The court denies Canon’s request for monetary sanctions against
Galstyan’s counsel because Canon’s notice of motion does not identify the
attorney against whom the sanction is sought, as required. (Code Civ. Proc., § 2023.040 [a request for
sanction shall, in the notice of motion, identify every attorney against whom
the sanction is sought].)
ORDER
The court grants defendant Canon Business Properties, Inc.’s motion to
compel defendant Karlen Galstyan dba KG Road Service to serve responses to Canon’s
Requests for Production of Documents, Set Two.
(Code Civ. Proc., § 2031.300, subd. (b).)
Pursuant to Code of Civil Procedure section 2031.300, the court orders
defendant Karlen Galstyan dba KG Road Service (1) to serve on defendant Canon
Business Properties, Inc. full and complete verified responses, without
objections, to defendant Canon Business Properties, Inc.’s Requests for
Production of Documents, Set Two, that comply with Code of Civil Procedure
sections 2031.210 through 2031.250, and (2) to produce to defendant Canon
Business Properties, Inc. all documents and things in defendant Karlen Galstyan
dba KG Road Service’s possession, custody, or control which are responsive to
those requests, within 20 days of the date of this order.
The
court grants defendant Canon Business Properties, Inc.’s request for monetary sanctions
against defendant Karlen Galstyan dba KG Road Service.
The court orders defendant Karlen Galstyan dba KG Road Service to pay monetary sanctions in the amount
of $660 to defendant Canon Business Properties, Inc. within 30 days of the date of this
order. (Code Civ. Proc., § 2031.300,
subd. (c).)
The
court denies Canon Business Properties, Inc.’s request for monetary sanctions against defendant Karlen
Galstyan dba KG Road Service’s counsel.

The
court orders defendant Canon Business Properties, Inc. to give notice of
this order.
