Motion for Summary Judgment or Summary Adjudication
On October 20,
2021, the court granted the motion to stay filed by defendant Travelers
Property Casualty Company of America (“Defendant”) and ordered that the
proceedings in this action are stayed pending resolution of the claims against
Vinculums Services, LLC in the underlying Los Angeles Superior Court case Figueroa
v. AT&T Corporation, Case No. BC701989.
Defendant filed a “Report
re: Status of Underlying Action” with the court on October 12, 2022, advising
the court that the underlying Figueroa action has not been resolved, and
that trial has been continued to February 14, 2023. Defendant requests the court continue the
hearings set for October 27, 2022 to a date in March, 2023.
On October 14,
2022, plaintiff Arch Insurance Company (“Plaintiff”) filed its “Report re:
Status of Underlying Action and Stay” that also advised the court that trial in
the Figueroa action has been continued to February 14, 2023. In its status report, Plaintiff requests the
court lift the stay of proceedings and rule on Plaintiff’s pending motion for
summary judgment.
The court
continues the hearing on the motion for summary judgment or, in the
alternative, summary adjudication, filed by Plaintiff on January 20, 2021,
because the action is stayed pursuant to the court’s October 20, 2021
order. If any party believes that there
is good cause to lift the stay imposed by the court, they may file a motion to
lift the stay.
The court orders that
(1) the hearing on Plaintiff’s motion for summary judgment or, in the
alternative, summary adjudication, (2) the Case Management Conference, and (3) the
Status Conference re Underlying Case are continued to __________________, 2023,
at 10:00 a.m.
The court orders the
parties to file a joint report re status of the underlying case no later than
__________________, 2023.
The court orders Plaintiff
to give notice of this order.
