DISCUSSON

Plaintiff Marcelino Gutierrez (“Plaintiff”) moves the court for an order (1) compelling defendant Mahmoud Nahian (“Defendant”) to appear for and testify at deposition, and (2) awarding monetary sanctions in favor of Plaintiff and against Defendant in the amount of $2,685.

The court grants Plaintiff’s motion to compel Defendant to appear for and testify at deposition.  (Code Civ. Proc., § 2025.450, subd. (a).)

The court denies Plaintiff’s request for monetary sanctions against Defendant because the court finds that the circumstances presented make the imposition of the sanction unjust.  (Code Civ. Proc., § 2025.450, subd. (g)(1).)

ORDER

The court orders defendant Mahmoud Nahian to attend and testify at a deposition to be taken by counsel for plaintiff Marcelino Gutierrez on ______________________, 2023, at 9:30 a.m., to be conducted by a videoconference platform selected by plaintiff Marcelino Gutierrez.

The court denies all requests for sanctions.

The court orders plaintiff Marcelino Gutierrez to give notice of this ruling.
