Special Interrogatories
The court considered the moving and opposition papers filed in
connection with this motion. No reply
papers were filed.
DISCUSSION
Defendant Simone S. Shah, individually and as trustee of the Simone
Shah Trust (“Defendant”) moves the court for an order (1) compelling plaintiffs
Jen Bosworth and Miles Horton (“Plaintiffs”) to respond to Defendant’s Special
Interrogatories, numbers 8, 9, 11, 35-62, 65, 87, 89, 90, 92-94, and 98, and
(2) awarding sanctions in favor of Defendant and against Plaintiff in the
amount of $2,160.
The court entered judgment in favor of Defendant and against
Plaintiffs on April 15, 2022.
Defendant’s motion requests that the court compel the responses of
pre-judgment discovery and, thus, is moot in light of the judgment entered in
favor of Defendant in this action. The
court therefore finds that it has no jurisdiction to grant the relief requested
by Defendant’s motion.
The court orders that the Motion to Compel Further Responses to First
Set of Special Interrogatories and Request for Sanctions, filed by defendant
Simone S. Shah, individually and as trustee of the Simone Shah Trust on
September 21, 2021, is taken off calendar as moot.
IT IS SO ORDERED.
