Champion Power Equipment’s ex parte as follows.
The court grants defendant
Champion Power Equipment’s request to file an amended motion for summary
judgment or, in the alternative, summary adjudication pursuant to the court’s
October 25, 2023 order determining that Texas law shall govern this action.
The court orders that the
February 22, 2024 hearing on defendant Champion Power Equipment’s motion for
summary judgment or, in the alternative, summary adjudication is taken
off-calendar.
The court finds good cause to
hear the amended motion for summary judgment or summary adjudication within 30
days of trial and sets a hearing on defendant Champion Power Equipment’s
amended motion for summary judgment or, in the alternative, summary
adjudication for May 2, 2024, at 10:00 a.m. in Department 53.
The court orders defendant
Champion Power Equipment to file with the court and serve on plaintiff Nancy Del
Socorro Diaz Martinez the amended motion for summary judgment or, in the
alternative, summary adjudication within the time required by Code of Civil
Procedure section 437c.
