Motion for Summary Judgment
Defendants Olympia Health Care
LLC, dba Olympia Medical Center and Alecto Healthcare Services, LLC
(“Defendants”) filed the pending motion for summary judgment on November 14,
2022.
On January 13, 2023, plaintiff
John Watts Jr. (“Plaintiff”) filed the “Declaration of Stanley Stone in
Opposition to Defendant’s Motion for Summary Judgment,” wherein Plaintiff’s
counsel (1) states that, under the circumstances described in his declaration,
he forgot to calendar the motion for summary judgment and the response date,
and therefore forgot about this motion, and (2) requests a continuance of the
hearing date. (Stone Decl., ¶¶ 2,
4-5.)
The court overrules
Defendants’ objections to the January 13, 2023 declaration filed by
Plaintiff.
The court orders that the hearing
on defendants Olympia Health Care LLC, dba Olympia Medical Center and Alecto
Healthcare Services, LLC’s motion for summary judgment is continued from
January 30, 2023, to February 28, 2023 at 10:00 a.m., in Department 53.
The court orders plaintiff John
Watts Jr. to file any opposition papers no later than February 10, 2023.
The court orders defendants
Olympia Health Care LLC, dba Olympia Medical Center and Alecto Healthcare
Services, LLC to file any reply papers no later than February 22, 2023.
The court orders plaintiff
John Watts Jr. to give notice of this ruling.
