Motion to Compel Further Responses to Requests for Admissions
The court
considered the moving papers filed in connection with this motion. No opposition or reply papers were filed.
DISCUSSION
Plaintiff Anchor General Insurance Company (“Plaintiff”) moves the court
for an order (1) compelling defendant Quincy Lee King (“Defendant”) to provide
further responses to Plaintiff’s Requests for Admissions, numbers 7, 10, 12,
13, 14, and 15, and (2) awarding monetary sanctions in favor of Plaintiff and
against Defendant in the amount of $720.
The court grants Plaintiff’s motion to compel Defendant’s further
responses to Requests for Admissions, numbers 7, 10, 12, 13, 14, and 15 because
Defendant’s answers to those requests are evasive and incomplete since they do
not comply with Code of Civil Procedure section 2033.220, subdivision (c). (Code Civ. Proc., § 2033.290, subd.
(a)(1).)
The court grants Plaintiff’s request for monetary sanctions. (Code Civ. Proc., § 2033.290, subd.
(d).) The court finds that $555 ((3
hours x $165 hourly rate) + $60 filing fee) is a reasonable amount of sanctions
to impose against Defendant in connection with this motion. (Solis Decl., ¶¶ 6-7.)
ORDER
The court grants plaintiff Anchor General Insurance Company’s motion
to compel further responses to requests for admissions.
Pursuant to Code of Civil Procedure section 2033.290, the court orders
defendant Quincy Lee King to serve further, full and complete answers to
plaintiff Anchor General Insurance Company’s Requests for Admissions, numbers 7,
10, 12, 13, 14, and 15, which comply with Code of Civil Procedure sections
2033.210-2033.220, and 2033.240, within 20 days of the date of service of this
order.
The court orders defendant Quincy Lee King to pay sanctions to
plaintiff Anchor General Insurance Company in the amount of $555 within 30 days
of the date of service of this order.
The court orders plaintiff Anchor General Insurance Company to give
notice of this ruling.
