Motion to Compel Deposition of Defendant’s Person Most Knowledgeable

The court considered the moving, opposition, and reply papers filed in connection with this motion.

DISCUSSION

Plaintiff Virginia Zamora (“Plaintiff”) moves the court for an order (1) compelling defendant General Motors, LLC (“Defendant”) to produce its person most qualified for deposition, and (2) compelling Defendant to produce, at deposition, the documents responsive to the requests for production in her Notice of Deposition.

The court grants Plaintiff’s motion to compel Defendant to produce at the deposition of Defendant its person(s) most qualified to testify on its behalf as to category numbers 1 through 28 because Defendant has agreed to produce its person most qualified to testify on its behalf as to those matters.  (Def. Separate Statement, pp. 4:2-3, 12:22-24, 13:15-17, 15:3-5, 15:20-22, 16:16-19, 17:6-8, 17:18-21, 18:14-17, 19:10-12, 19:25-27, 20:8-10, 21:1-2, 21:21-24, 22:4-6, 22:25-27, 23:18-20, 24:10-13, 25:6-8, 26:2-4, 26:26-28, 27:22-24, 28:18-20, 29:13-15, 30:10-12, 21:6-8.)

The court grants Plaintiff’s motion to compel Defendant to produce the documents responsive to requests for production numbers 1-8.  Defendant may designate the documents produced in response to requests numbers 7 and 8 as confidential pursuant to the Stipulation and Protective Order filed in this action on October 24, 2022.

The court denies Plaintiff’s motion to compel Defendant to produce the documents responsive to requests for production numbers 9-24 because they call for the production of documents that are neither relevant to the subject matter involved in the pending action nor reasonably calculated to lead to the discovery of admissible evidence.  (Code Civ. Proc., § 2017.010.)

ORDER

The court grants plaintiff Virginia Zamora’s motion to compel the deposition of defendant’s person most knowledgeable as follows.

The court orders defendant General Motors, LLC (1) to designate and produce for deposition those of its officers, directors, managing agents, employees, or agents who are most qualified to testify on its behalf as to the matters set forth in category numbers 1 through 28 in plaintiff Virginia Zamora’s Notice of Deposition, and (2) to produce the documents responsive to the requests for production of documents, numbers 1 through 8, requested in plaintiff Virginia Zamora’s Notice of Deposition within 30 days of the date of this order.

The court orders plaintiff Virginia Zamora to give notice of this ruling.
