Motion to Compel Deposition of Defendant’s Person Most Qualified and Production of Documents

The court considered the moving and opposition papers filed in connection with this motion.  No reply papers were filed.

DISCUSSION

Plaintiff Maria Rivas (“Plaintiff”) moves the court for an order (1) compelling defendant General Motors, LLC (“Defendant”) to produce its person most qualified for deposition on the matters for examination set forth in the Amended Notice of Deposition, and (2) compelling Defendant to produce documents responsive to the Requests for Production of Documents, numbers 1-16, in the Amended Notice of Deposition.

The court finds that Plaintiff did not submit a declaration stating that, after the deponent failed to attend the deposition and produce documents described in the deposition notice, Plaintiff contacted Defendant to inquire about the nonappearance of its person most qualified and therefore denies Plaintiff’s motion.  (Code Civ. Proc., § 2025.450, subd. (b)(2).)

ORDER

            The court denies plaintiff Maria Rivas’s motion to compel deposition of person most qualified and production of documents.

            The court orders counsel for plaintiff Maria Rivas and counsel for defendant General Motors LLC to meet and confer no later than October 27, 2023, to make a reasonable and good faith attempt to informally resolve the issues presented by plaintiff Maria Rivas’s motion. 

            The court orders defendant General Motors LLC to give notice of this ruling.
