each motion.
DISCUSSION
Plaintiff Blue Nile Properties, LLC (“Plaintiff”) served its Requests
for Admissions, Set Number One, to defendant Lorenzo Cabrera Sanchez (“Defendant”)
on June 15, 2022. (Starre Decl.,¶
2.) Defendant did not serve responses
until July 28, 2022, following the filing of Plaintiff’s motion to deem
requests admitted.
The court denies as moot Plaintiff’s motion to deem its requests for
admissions admitted since Defendant has, before the hearing on this motion,
served verified responses to the requests for admission. (Code Civ. Proc., § 2033.280, subd.
(c).)
The court grants Plaintiff’s request for sanctions against
Defendant. The court finds that monetary
sanctions in the amount of $510 ((1 hour x $450 per hour) + $60 motion filing fee
= $510) is a reasonable amount of monetary sanctions to impose against
Defendant on this motion. (Code Civ.
Proc., § 2033.280, subd. (c).)
Plaintiff served its Form Interrogatories, Set One, General and
Unlawful Detainer, to Defendant on June 15, 2022. (Starre Decl., ¶ 2.) Defendant served untimely, verified responses
on July 28, 2022, following Plaintiff’s motion to compel responses to form
interrogatories.
The court denies as moot Plaintiff’s motion to compel responses to
form interrogatories since Defendant has served responses.
The court grants Plaintiff’s request for sanctions against
Defendant. The court finds that monetary
sanctions in the amount of $510 ((1 hour x $450 per hour) + $60 motion filing
fee = $510) is a reasonable amount of monetary sanctions to impose against
Defendant on this motion. (Code Civ.
Proc., § 2030.290, subd. (c).)
Plaintiff served its Request for Production of Documents, Set One, to
Defendant on June 15, 2022. (Starre
Decl., ¶ 2.) Defendant served
verified responses on July 28, 2022.
The court denies as moot Plaintiff’s motion to compel responses to
requests for production of documents since Defendant has served responses.
(Code Civ.
Proc., § 2031.300, subd. (c).)
