Motion for Trial Preference
The court notes that, on
February 14, 2023, plaintiff Dennis Platt filed a sur-reply and supporting
declaration in connection with the pending motion for trial preference.
In light of the information
set forth in the sur-reply and supporting declaration about events that have
occurred after the filing of the motion and after the filing of defendant FCA
US LLC’s opposition, the court exercises its discretion to continue the hearing
on this motion in order to give plaintiff Dennis Platt an opportunity to
present additional evidence concerning his health, and to give defendant FCA US
LLC an opportunity to address and respond to that evidence in a supplemental
opposition.
The court therefore orders
that the hearing on plaintiff Dennis Platt’s motion for trial preference is
continued to March 23, 2023, at 10:00 a.m.
Plaintiff Dennis Platt shall
file and serve by electronic service any supplemental papers in support of the
motion for trial preference (with any memorandum of points and authorities not to
exceed five pages in length) no later than February 28, 2023.
Defendant FCA US LLC shall
file and serve by electronic service any supplemental opposition (with any
memorandum of points and authorities not to exceed five pages in length) no
later than March 10, 2023.
Plaintiff Dennis Platt shall
file and serve by electronic service any supplemental reply papers (with any
memorandum of points and authorities not to exceed five pages in length) no
later than March 16, 2023.
The court orders plaintiff Dennis Robert Platt to give notice of this
ruling.
