Motion for Interlocutory Judgment for Partition by Sale

Plaintiff Yvette Lloyd-Brady (“Plaintiff”) filed the pending motion for interlocutory judgment for partition by sale on October 30, 2023, requesting that the court enter an interlocutory judgment of partition in favor of Plaintiff and against defendant Edmund Tracy Lloyd (“Defendant”).

The default of Defendant was entered on May 26, 2023.  The court (1) deems Plaintiff’s motion to be a request for interlocutory judgment of partition by default, and (2) grants that request.  (Code Civ. Proc., §§ 585, 872.720.)  The court will enter the interlocutory judgment of partition by default pursuant to Code of Civil Procedure section 872.720, lodged by Plaintiff on October 30, 2023, as modified by the court.

Plaintiff Yvette Lloyd-Brady will need to file a motion or ex parte application with the court to appoint a referee to sell the property pursuant to the interlocutory judgment of partition.  (Code Civ. Proc., § 873.010, subd. (a).)

The court sets (1) an Order to Show Cause re entry of judgment of partition of real property, and (2) a Status Conference re partition of property and appointment of a referee to sell the property, on February 27, 2024, at 8:30 a.m., in Department 53.
