Motion to Compel Defendant’s Further Responses to Form Interrogatories

The court considered the moving, opposition, and reply papers filed in connection with this motion.

DISCUSSION

Plaintiff Rafael Cisneros (“Plaintiff”) moves the court for an order compelling defendant General Motors LLC (“Defendant”) to serve further responses to Plaintiff’s Form Interrogatories, numbers 12.1 and 15.1.

As a threshold matter, the court finds that Plaintiff has submitted a meet and confer declaration that satisfies Code of Civil Procedure section 2016.040 because (1) Plaintiff sent a letter to Defendant setting forth the alleged deficiencies in its responses, (2) counsel for Plaintiff thereafter attempted to meet and confer with counsel for Defendant telephonically and requested Defendant return counsel’s call to meet and confer, and (3) Defendant did not respond to any of Plaintiff’s efforts to meet and confer.  (Code Civ. Proc., §§ 2030.300, subd. (b)(1), 2016.040; Rabieian Decl., Exs. 4, pp. 2-5 [setting forth deficiencies with interrogatory numbers 12.1 and 15.1]; Rabieian Decl., ¶¶ 7-9 [Defendant did not respond to various efforts to meet and confer].)

The court grants Plaintiff’s motion to compel Defendant’s further response to Form Interrogatories, number 12.1 because (1) the objections to this interrogatory are without merit, and (2) Defendant’s exercise of the option to produce documents under section 2030.230 is unwarranted.  (Code Civ. Proc., § 2030.300, subds. (a)(1), (a)(2).)  

The court grants Plaintiff’s motion to compel Defendant’s further response to Form Interrogatories, number 15.1 because the answer to that interrogatory is evasive and incomplete.  (Code Civ. Proc., § 2030.300, subd. (a)(1).)

ORDER

            The court grants plaintiff Rafael Cisneros’s motion to compel further responses to form interrogatories.

            Pursuant to Code of Civil Procedure section 2030.300, the court orders defendant General Motors LLC to serve further, full and complete answers to plaintiff Rafael Cisneros’s Form Interrogatories, numbers 12.1 and 15.1, which comply with Code of Civil Procedure sections 2030.210-2030.250, within 20 days of the date of this order.

            The court orders plaintiff Rafael Cisneros to give notice of this ruling.
