Judge: Robert B. Broadbelt, Case: 24STCV33960, Date: 2025-01-24 Tentative Ruling
Case Number: 24STCV33960 Hearing Date: January 24, 2025 Dept: 53
Guzman v. Steadfast Insurance Company  24STCV33960
Ex
Parte Application  1/24/25
The
court denies petitioner’s ex parte application for an order to shorten time to
hear petitioner’s motion to compel arbitration, appointment of arbitrator and
selection of February 6, 2025 as the arbitration hearing date, and to advance
the hearing on that motion to January 31, 2025 or February 3, 2025.
The
court does not find good cause to grant petitioner’s request for an order
shortening time on the hearing on petitioner’s motion/petition to compel
arbitration, appointment of arbitrator and selection of February 6, 2025 as the
arbitration hearing date, or to prescribe shorter times for the filing and
service of papers than the times specified in Code of Civil Procedure section
1005, subdivision (b).  (Cal. Rules of
Court, rule 3.1300, subd. (b).)
The
court finds that petitioner has not satisfied the requirement of California
Rules of Court, rule 3.1202, subdivision (c), that an applicant for an ex parte
order must make an affirmative factual showing in a declaration containing
competent testimony based on personal knowledge of irreparable harm, immediate
danger, or other statutory basis for granting relief ex parte.
The court
orders petitioner to give notice of this order.
