Order RE: mOTIONs in limine |
The court rules on plaintiff’s motions
in limine on Phase 2 of the bifurcated trial as follows.
Plaintiff’s Motion in Limine No. 1
The court denies plaintiff’s request
to exclude all evidence and testimony of the trust documents of Sam Schermer
and his intent as reflected in those documents.
Although the court has concerns about whether that evidence (1) is
relevant to prove or disprove any disputed fact that is of consequence to the
determination of the issues presented in Phase 2 of the bifurcated trial in
this action or (2) should be excluded pursuant to Evidence Code section 352, it
is not clear to the court at this point whether all of the trust documents
should be excluded on those grounds.
Plaintiff’s Motion in Limine No. 2
The court grants plaintiff’s request
to exclude evidence regarding plaintiff’s personal relationship with her
father, Sam Schermer, because it is not relevant to prove or disprove any
disputed fact that is of consequence to the determination of the issues
presented in Phase 2 of the bifurcated trial in this action and pursuant to
Evidence Code section 352.
The court denies plaintiff’s request
to exclude evidence regarding plaintiff’s personal relationship with defendant
Linda Schermer.
Plaintiff’s Motion in Limine No. 3
The court grants defendants’ request
to exclude evidence of a video of Sam Schermer filmed in July 2014 where he discussed
his relationship with plaintiff because it is not relevant to prove or disprove
any disputed fact that is of consequence to the determination of the issues
presented in Phase 2 of the bifurcated trial in this action and pursuant to
Evidence Code section 352.
