Order RE:

 

ex parte application to strike plaintiff’s unauthorized motion for summary judgment or, in the alternative, to continue the hearing pursuant to ccp § 437c(h) and to continue trial

 

 

The court grants in part and denies in part defendants’ ex parte application, filed April 10, 2025, and presented to the court on April 11, 2025, as follows.

The court denies defendants’ request for an order striking plaintiff’s motion for summary adjudication.

The court orders that the hearing on plaintiff’s motion for summary adjudication is continued from June 26, 2025 to October 8, 2025, at 10:00 a.m., in Department 53.  (Code Civ. Proc., § 437c, subd. (h).)

The court orders that the discovery cutoff date is extended until and including August 29,  2025, for the limited purpose of permitting defendants to take the depositions of Becky Henson and Dawn Hanson.

The court orders that the hearing on defendants’ motion to compel further discovery responses, filed on December 20, 2024, is continued from May 23, 2025 to May 30, 2025, at 10:00 a.m., in Department 53.  The court orders that defendants are granted leave to have their motion to compel further discovery responses heard on May 30, 2025.

            The court orders that trial (phase II) is continued from August 6, 2025 to November 19, 2025 at 11:00 a.m., in Department 53.

            The court orders that the Final Status Conference is continued from July 24, 2025 to November 6, 2025, at 8:30 a.m., in Department 53.

            The court orders that the deadline for the parties and their counsel to hold a meeting, conference call, or videoconference to discuss and try to settle all issues in the case is extended to October 17, 2025.   

            The court orders defendants to give notice of this ruling.
