Motion to Compel Arbitration

            On September 26, 2024, the Court of Appeal filed its Opinion in this case, in which the Court of Appeal ordered (1) that the trial court’s June 5, 2023 order denying defendants Erla Dogg Ingjaldsdottir a/k/a Erla Dogg, Tryggvi Thorsteinsson, Minarc, Inc., MNM Mod Corp., a/k/a MNMmod, a/k/a mnmMOD, d/b/a MNMmod Building Solutions’ motion to compel arbitration is reversed, and (2) that the trial court is directed to enter a new order granting the motion to compel arbitration.  The Court of Appeal issued the remittitur on December 20, 2024.

            The court orders that the stay pending completion of appeal from the court’s June 5, 2023 order denying defendants Erla Dogg Ingjaldsdottir a/k/a Erla Dogg, Tryggvi Thorsteinsson, Minarc, Inc., and MNM Mod Corp., a/k/a MNMmod, a/k/a mnmMOD, d/b/a MNMmod Building Solutions’ motion to compel arbitration, issued by the court in its January 12, 2024 minute order, is now lifted.

            Pursuant to the Court of Appeal’s directions in its September 26, 2024 Opinion, the court grants defendants Erla Dogg Ingjaldsdottir a/k/a Erla Dogg, Tryggvi Thorsteinsson, Minarc, Inc., and MNM Mod Corp., a/k/a MNMmod, a/k/a mnmMOD, d/b/a MNMmod Building Solutions’ motion to compel arbitration, filed on November 10, 2022.

            The court orders (1) defendants Erla Dogg Ingjaldsdottir a/k/a Erla Dogg, Tryggvi Thorsteinsson, Minarc, Inc., and MNM Mod Corp., a/k/a MNMmod, a/k/a mnmMOD, d/b/a MNMmod Building Solutions and plaintiffs Greg A. Mooradian and Debra A. Mooradian, individually and in their capacities as trustees of the Greg and Debra Mooradian Family Trust, to arbitrate plaintiffs’ claims in this action, and (2) this action is stayed until arbitration is completed.

            The court sets an Order to Show Cause re completion of arbitration for hearing on November 4, 2025, at 8:30 a.m., in Department 53.

            The court orders defendants Erla Dogg Ingjaldsdottir a/k/a Erla Dogg, Tryggvi Thorsteinsson, Minarc, Inc., and MNM Mod Corp., a/k/a MNMmod, a/k/a mnmMOD, d/b/a MNMmod Building Solutions, to give notice of this ruling.
