The court denies plaintiff’s ex parte application (1) because plaintiff did not file a proposed order as required by California Rules of Court, rule 3.1201, and (2) without prejudice to seeking appropriate relief, if necessary, after plaintiff has complied with the court’s order set forth below.

The court orders plaintiff and defendants’ counsel to meet and confer no later than February 9, 2023, to determine which motions or demurrers (“motions”) which have been filed in this case need to be rescheduled on the court’s calendar in Department 53.  The court expects the parties to prepare and lodge with the court a stipulation and proposed order which lists (1) the party who filed the motion, (2) the title of the motion, (3) the date the motion was filed, and (4) the Court Reservation System reservation number for the motion, and which states that the court now sets the motion for hearing on __________________, 2023, at 10:00 a.m., in Department 53.

The court expects the parties to cooperate to schedule and complete Informal Discovery Conferences for each of the motions to compel further responses to discovery before the hearing dates scheduled for those motions.     

The court orders plaintiff to give notice of this order.
