Plaintiff's Motion to Compel Defendant R Family Property II, LLC's Further Response to Special Interrogatory No. 55 (ROA 103) is GRANTED.

Plaintiff seeks information from Defendant regarding its inspection of its own property for fire safety.

Defendant responded with objections only, contending that the prefatory instructions were improper and overbroad, and that the interrogatory is compound, vague, ambiguous, argumentative, and 'assumes facts.' The court finds that these objections do not warrant failure to provide any substantive response whatsoever to the interrogatory, and they are overruled.

Defendant is ordered to serve a verified further response on or before January 26, 2024.

Plaintiff's request for monetary sanctions is denied in the court's discretion, and on the additional independent ground that Plaintiff did not submit a declaration 'setting forth facts supporting the amount of any monetary sanction sought.' (Code Civ. Proc. § 2023.040.) Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
