Defendant North County Scaffold & Plank, Inc.'s unopposed Application for Determination of Good Faith Settlement (ROA 249) is GRANTED.
The court finds the settlement between Defendant North County Scaffold & Plank, Inc. and Plaintiffs David Luna and American Claims Management, Inc. to be in good faith. This determination bars any other joint tortfeasor or co-obligor from any further claims against North County Scaffold & Plank, Inc. for equitable comparative contribution or partial or comparative indemnity based on comparative negligence or comparative fault arising out of the claims asserted by Plaintiffs. (Code Civ. Proc. ยง 877.6(c).) The court has received and reviewed the remittitur (ROA 255), which indicates Plaintiff's appeal was dismissed. Accordingly, the court orders the stay of this action lifted and sets a case management conference for April 5, 2024.
Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
The court notes Defendant failed to pay the required $60.00 motion fee. If the fee is not posted by 5:00 p.m. on January 19, 2024, the court will not adopt its tentative ruling granting the motion and the motion will instead be ordered vacated.
