Attorneys Kreditor and Quilano's unopposed Motion to Be Relieved as Counsel for Defendant Chunling Wan and unopposed (Amended) Motion to Be Relieved as Counsel for Defendant Qilin Chang are GRANTED. (ROA 153 and 161.) Attorney Quilano is directed to e-file updated, completed revised proposed orders (Judicial Council Form MC-053) for the court's signature, including identifying the persons appearing at the hearing, within five (5) days. 'The [proposed] order must specify all hearing dates scheduled in the action or proceeding, including the date of trial....' (Cal. R. Court, Rule 3.1362(e).) Once the court has signed the orders, Attorney Quilano is ordered to serve a copy of the signed orders on Chunling Wan and Qilin Chang at their last known address, and on all other parties, and to promptly file a proof of service of the signed order with the court.
Attorneys Kreditor and Quilano's Motion to Be Relieved as Counsel for Defendant Worlden EC, Inc. is CONTINUED to December 15, 2023 at 8:30 a.m. (ROA 157.) As to this motion counsel initially failed to file a declaration and mistakenly filed a duplicate of the notice of motion instead. (Compare ROA 158 with ROA 157.) Counsel subsequently corrected the error by filing a declaration on October 9, 2023. (ROA 166.) The declaration states the client was served by mail and that the client's address was confirmed as current by 'checking the owner of the last known address of 28760 Red Gum Drive, Lake Elsinore, CA 92532.' It is not clear how this complies with court rules to provide facts showing the address is current, since it essentially states only that the address was confirmed by checking the address. (Cal. R. Court, rule 3.1362(d).) The motion is continued to allow time for counsel to either confirm the address is current, or that they were unable to confirm the current address after making reasonable efforts to do so, and to timely file and serve amended papers giving notice of the continued hearing.
