Plaintiffs' Motion for Final Approval of Class Action Settlement, Attorney Fee Award, Cost Award, and Class Representative Enhancement Payments (ROA 44) is CONTINUED to December 15, 2023 at 8:30 a.m.
Separately from their moving memorandum, Plaintiffs filed a 'Response to Objectors Raymond Celiceo, Jimmy Phanmanivong, and Alejandro Romo's Objection to Settlement.' (ROA 53.) Therein, Plaintiffs refer to a 'Notice of Objection.' (ROA 53 at 4:8 and 9:6.) However, Plaintiffs did not submit copies of any written objections to the court. Likewise, although the administrator states that three written objections were received, the objections were not attached to the administrator's declaration. (ROA 49, Lee Decl. at ΒΆ 11.) The court must see these objections before it can appropriately evaluate and rule upon the objections and this motion.
Accordingly, Plaintiffs are ordered to file and serve copies of the written objections on or before Monday, December 11, 2023 so the court may consider them. Plaintiffs are requested to submit courtesy copies directly to Department 65 as well.
