Attorney Westmoreland's Motion to Be Relieved as Counsel of Record for Defendants and Cross-Complainants Elissa Stone and Rae Relatores (ROA 108) is CONTINUED to June 21, 2024 at 8:30 a.m.
'The notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case.' (Cal. R. Court, rule 3.1362(d).) 'Proof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing.' (Cal. R. Court, rule 3.1300(c).) Here, Attorney Westmoreland gave notice of hearing for October 11, 2024 and proof of service was filed with the moving papers. The parties thereafter stipulated to advance the hearing to May 6, 2024, a Monday, which the court then continued to May 10, 2024, to coincide with its usual Friday law and motion calendar. There is no proof of service on the clients as to the May 10, 2024 hearing date.
Accordingly, the motion is continued to allow time for Attorney Westmoreland to file and serve sufficient notice of the continued hearing date on both clients and all other parties.
