Plaintiff's Motion to Approve Proposition 65 Settlement and Stipulation (ROA 37) is GRANTED.

The court approves the parties' settlement as set forth in their Stipulation for Entry of Consent Judgment found within ROA 44. In approving the settlement, the court finds that the proposed warning complies with the requirements of Health and Safety Code section 25249.6 et seq., the attorney fee award is reasonable, and the civil penalty imposed on Defendant is reasonable. (Health & Saf. Code § 25249.7(f)(4).) However, Plaintiff is ordered to submit a revised proposed Judgment within five (5) days. The proposed Judgment should contain all of the stipulated terms of the consent judgment, rather than attaching the stipulation as an exhibit to the proposed Judgment.

The Case Management Conference is ordered VACATED in light of the court's ruling granting the motion.
