Plaintiffs' Motion for Preliminary Approval of Class Action and PAGA Settlement (ROA 36) is GRANTED.
The court finds there is sufficient evidence to conclude, on a preliminary basis, the proposed settlement is fair and reasonable. (Chaves v. Netflix, Inc. (2008) 162 Cal.App.4th 43, 52.) However, the court notes a few minor errors in the proposed class notice. The court's address is incorrect on the notice; the correct address is 330 W. Broadway, San Diego, CA 92101. The judicial officer is Judge Robert C. Longstreth. The reference to the Code of Civil Procedure on the page should be to section 384 instead of to section 386. Plaintiffs' counsel is to ensure these errors are corrected before the notice is sent to the class.
The court notes the preliminary approval motion greatly exceeded applicable page limits. (Cal. R. Court, rule 3.1113(d).) Plaintiffs are to comply with all court rules going forward, including page limits.
The final approval hearing is scheduled for December 13, 2024 at 8:30 a.m. in this department. This hearing reservation contemplates one set of moving papers and the papers are to be within the page limits. The moving papers are to be timely filed per Code.
Plaintiffs are to submit a revised proposed order reflecting the final approval hearing, omitting paragraph 17, and attaching the updated class notice. With regard to paragraph 17, Plaintiffs did not request, nor did the court approve, an injunction pending final approval of the proposed settlement.
