Defendant Kaiser Foundation Hospital's Motion for Summary Judgment or, in the Alternative, Summary Adjudication (ROA 44) is ordered CONTINUED to July 19, 2024 at 8:30 a.m.

Plaintiff's opposition and supporting declaration set forth a sufficient basis for the court to conclude 'facts essential to justify opposition may exist but cannot, for reasons stated, be presented' at the time the opposition was due. (Code Civ. Proc. § 437c(h).) Accordingly, the court grants Plaintiff's request for continuance in order to 1) further meet and confer with Defendant regarding Defendant's responses to written discovery propounded on December 8, 2023 and January 1, 2024, if needed; 2) conduct the depositions of Defendant's Person Most Knowledgeable and Defendant's employee Kristen Kerr, to the extent they have not yet gone forward; and 3) conduct the deposition of Barbara Ferrier, a non-party witness.

Supplemental opposition and/or reply papers are to be submitted per Code in accordance with the continued hearing date. Supplemental opposition and reply memoranda of points and authorities are limited to ten (10) page.

Because the court is granting the request for continuance pursuant to section 437c(h), it does not reach Plaintiff's alternative request under subdivision (i).

The court further orders trial continued to August 23, 2024 at 9:45 a.m. and orders the trial readiness conference continued to August 2, 2024 at 10:00 a.m.
