CASE TITLE: CASE TYPE:
Civil - Unlimited  Breach of Contract/Warranty Motion Hearing (Civil) 37-2022-00036041-CU-BC-CTL BIG EAGLES LLC VS ASSEF [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion to Be Relieved as Counsel of Record, 02/02/2024
The court has considered Attorneys Brittany Salamin and Daniels Watkins' unopposed Motion to Be Relieved as Counsel for Defendant Shahram Assef (ROA 118) and will hear this matter.
Where a motion to be relieved as counsel is served by mail, the attorney is required to confirm the client's current address. 'Merely demonstrating that the notice was sent to the client's last known address and was not returned... is not, by itself, sufficient to demonstrate that the address is current.' (Cal. R. Court, rule 3.1362(d).) Attorney Salamin's declaration states she confirmed the client's address by conducting 'a Lexis Nexis search of client's address.' (Decl. at ΒΆ 3(b)(1)(d).) The moving papers were served on Mr. Assef at an address located on Nabal Drive, which differs from a writ of attachment served on Mr. Assef at an address located on Markey Way.
The court will hear from counsel as to the efforts made to ensure Mr. Assef received notice of this motion.
