CASE TITLE: CASE TYPE:

Civil - Unlimited  PI/PD/WD - Auto Discovery Hearing 37-2022-00039916-CU-PA-CTL CROUSE VS GAJON [IMAGED] CAUSAL DOCUMENT/DATE FILED:

Plaintiff's unopposed Motion to Quash Subpoenas (ROA 34) is GRANTED.

Conditions unrelated to the injuries a plaintiff has alleged in a lawsuit are privacy protected and not discoverable. See Britt v. Superior Court (1978), 864, holding that the trial court 'obviously erred in ordering plaintiffs to disclose to defendant their entire lifetime medical histories.' Here, Plaintiff asserts the subpoenas issued by Defendants to Kaiser Permanente/Southern California, Kaiser Permanente Billing Department/The Central Release of Information Unit, and Kaiser Radiology/Release of Information Unit seek information unrelated to the injuries of body parts at issue in this case, potentially including release of irrelevant mental health records. The court's review of the subpoenas indicates that Plaintiff is correct, and Defendants make no argument to the contrary. Nor is there any indication that Defendants have offered to clarify or limit the scope of the supoenas.

Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
