The court, on review of its records, observes Petitioner David Harter has filed two Notices of Related Case (ROA 25, 36) identifying two other cases that are related to this matter: Case No.
37-2019-00022444, Harter v. Rancho Rios HOA in Department 67 and Case No. 37-2021-00050363, Harter v. Rancho Rios HOA in Department 60.
It appears Petitioner has not yet complied with the court's local rules, which require that Petitioner 'must, within 15 days of the filing of the notice of related case, schedule an ex parte hearing with the judge who has the earliest filed unlimited civil case... in order to determine whether the cases should be ordered related and reassigned.' (San Diego Superior Court Local Rules, rule 2.1.3.1, emphasis added.) Accordingly, the court orders this action STAYED until Petitioner has complied with the local rule.
Respondent's Motion to Strike Petitioner's First Amended Petition for Writ of Mandate and for an Order Dismissing the Litigation in its Entirety or Requiring Petitioner to Post Security and for a Stay of All Proceedings (ROA 49) is ordered VACATED.
The Status Conference is also ordered VACATED.
Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
