Plaintiff's Motion to Compel the Deposition of Defendant General Motors, LLC's Person Most Qualified and for Sanctions (ROA 12) is DENIED on the grounds it is premature.

A motion to compel a deposition may be brought when a deponent 'fails to appear for examination, or to proceed with it, or to product for inspection any document, electronically stored information, or tangible thing described in the deposition notice.' (Code Civ. Proc. § 2025.450(a), emphasis added.) Here, Plaintiff has yet to proceed with the deposition. Defendant's written objections served in response to the notice of deposition, though clearly excessive, appear to indicate Defendant will allow testimony on at least some of the topics, and will produce at least some of the requested documents. Until the deposition is taken, it is premature to attempt to determine what questions and/or documents will be at issue and to make a priori rulings based on any such determinations. Accordingly, the motion is denied.

Once confirmed, this ruling shall be the final ruling of the court and no further written order is required.
